WhatsApp messages as evidence in the UK

WhatsApp messages turn up in family, employment, housing and money disputes all the time. How they’re presented can make the difference between a judge reading them properly and skimming past a pile of screenshots.

Where WhatsApp evidence comes up

Five habits that help

  1. Export, don’t screenshot. WhatsApp’s Export chat gives every message with its date, time and sender. How to export a chat.
  2. Keep the original export file, unchanged, somewhere safe. Don’t open it in a word processor and save over it.
  3. Present it so messages can be found. Numbered messages and page numbers let you, the other side and the judge refer to the same message. That’s what a numbered PDF is for.
  4. Be open about what you left out. If you only include some dates or people, say so. ChatBundle prints the filters on the cover and marks each gap.
  5. Follow the court’s directions. Bundles have rules on format, page limits and deadlines that differ between courts. Your order or the court’s guidance comes first.

Bundles and page limits

Many courts limit the size of a bundle, and judges dislike long ones. A long chat filtered to the relevant weeks, with message numbers kept from the full export, is usually much easier to justify than the whole thing. ChatBundle shows how many messages and pages you’re about to create before you download.

Keeping it private

The messages in a dispute are usually some of the most private things people have. ChatBundle doesn’t upload them: the export is read and the PDF is built in your browser, on your device. There’s no account to make and nothing kept after you close the tab.

Help if you’re representing yourself

ChatBundle makes the document; it can’t advise on your case. Free help is available from Support Through Court, Advocate (free help from barristers), Citizens Advice and local law centres.

Questions

Can I use WhatsApp messages as evidence?

Messages are often used as evidence in UK courts and tribunals. Whether particular messages can be used, and how much weight they carry, is for the court to decide in your case. If you’re unsure, get legal advice; Support Through Court and Advocate help people representing themselves.

Is it legal to use messages someone sent me?

You can generally show your own conversations to your lawyer or a court in your case. Be careful sharing them more widely, and never post them publicly. In family proceedings, there are strict rules on sharing court documents and information about children.

What if the other person deleted messages?

Deleted messages show as “This message was deleted” in the export. The other person’s phone, or a backup, may still have them. ChatBundle can only show what’s in your export.

Can ChatBundle tell if an export has been edited?

No tool can tell that from the file alone. What ChatBundle does is fingerprint the file you give it, so nobody can change it after the PDF is made without it showing.

Make the PDF now. Drop your export on ChatBundle, check the free preview of every message, then download a numbered PDF with a cover sheet, media index and fingerprint. Nothing is uploaded.
